وجهت إلى مانويلا، وهي امرأة تبلغ من العمر 33 عاما وأم لطفلين تعاني من الفقر في ريف السلفادور، تهمة القتل المشدد بعد حالة طارئة أثناء الولادة أدت إلى فقدان حملها. عندما أخذها والد مانويلا إلى المستشفى لمعالجة حالتها الطبية الطارئة، استجوبها الطاقم الطبي لمدة ثلاث ساعات عند وصولها، مما أدى إلى تأخير العلاج. كما أخر العاملون في المجال الطبي العلاج من خلال الإبلاغ عن مانويلا للإجهاض المشتبه به، وهو جريمة في السلفادور بسبب الحظر الشامل الذي يجرم الإجهاض في جميع الظروف، بما في ذلك حالات الطوارئ التوليدية والمضاعفات التي تنشأ أثناء الحمل والولادة وبعد الولادة.

Manuela, une femme de 33 ans, mère de deux enfants, vivant dans la pauvreté dans une région rurale du Salvador, a été accusée d'homicide aggravé à la suite d'une urgence obstétrique qui a entraîné la perte de sa grossesse. Lorsque le père de Manuela l'a emmenée à l'hôpital pour régler l'urgence médicale, le personnel médical l'a interrogée pendant trois heures à son arrivée, ce qui a retardé le traitement.

Manuela, una mujer de 33 años madre de dos hijos que vivía en situación de pobreza en El Salvador, fue acusada de homicidio agravado después de una emergencia obstétrica que le causó la pérdida de un embarazo. Cuando el padre de Manuela la llevó al hospital para que la atiendan por la emergencia médica, el personal del hospital la interrogó durante tres horas, lo que retrasó su tratamiento.

Manuela, a 33-year old woman and mother of two experiencing poverty in rural El Salvador, was charged with aggravated homicide after an obstetric emergency resulting in her pregnancy loss. When Manuela’s father took her to the hospital to address her medical emergency, medical personnel interrogated her for three hours upon arrival, delaying treatment.

On January 24, 2000, a petition was filed against the State of El Salvador before the Inter-American Commission on Human Rights (IACHR) alleging violation of the rights to life, health and full development of personality of a group of persons living with HIV.  The case was grounded on the State's failure to provide them with the triple therapy medication needed to prevent them from dying and to improve their quality of life.  The petitioners also claimed that the situation of the said persons constituted an instance of cruel, inhumane and degrading treatment.

El 24 de enero de 2000, la CIDH recibió una petición en la que se denunciaba al Estado de El Salvador por la violación de los derechos a la vida, a la salud y al desarrollo de la personalidad de un grupo de personas que viven con el virus de HIV. Ello por cuanto el Estado no les suministraba los medicamentos que integran la triple terapia necesaria para impedirles la muerte y mejorar su calidad de vida. La denuncia afirmaba, además, que la situación en la que se hallaban tales personas constituye un trato cruel, inhumano y degradante.
