كانت المسألة المطروحة في هذه القضية القيود المستمدة من القانون العام الإنجليزي بشأن مشاركة المؤسسات الخيرية في نشاط سياسي غير حزبي لضمان إجراء تغييرات في القوانين والسياسات لتعزيز أغراضها الخيرية. في كندا، أُدرجت هذه القيود في قانون ضريبة الدخل الكندي الذي نص على أنه لا يجوز للمؤسسات الخيرية المشاركة في الأنشطة السياسية غير الحزبية  سعيًا منها إلى إجراء تغيير في أي قانون أو سياسات إلا في حال كانت هذه الأنشطة  "مساعِدة لأنشطتها الخيرية وعرضية"، بحيث تُشكّل الأخيرة "إلى حد كبير جميع" موارد المنظمة.

Cette affaire concernait des restrictions issues de la common law anglaise à la participation des organismes de bienfaisance à des activités politiques non partisanes visant à obtenir des changements dans les lois ou les politiques pour contribuer à l’avancement de leurs fins de bienfaisance.

La cuestión objeto de este caso eran las restricciones derivadas del derecho consuetudinario inglés sobre la participación de organizaciones benéficas en actividades políticas no partidistas para lograr cambios en las leyes o políticas dirigidas a promover sus fines benéficos.

At issue in this case were restrictions derived from English common law on charities’ engagement in non-partisan political activity to secure changes to laws or policies to further their charitable purpose. In Canada these restrictions had been incorporated into Canada’s Income Tax Act (ITA), which stated that registered charities may only engage in non-partisan political activities to seek changes to any laws or policies if such activities were “ancillary and incidental” to their charitable activities, with the latter constituting “substantially all” of the organization’s resources.

في عام 2012، وافقت اللجنة الأفريقية لحقوق الإنسان والشعوب على النظر في هذه الشكوى ورأت أنها جديرة بالقبول. وقد رفع هذه الدعوى ثلاثة مدافعين بارزين عن حقوق الإنسان هم: منعم الجاك، وأمير سليمان، والراحل عثمان حميدة،  إثر استهدافهم بسبب تعاونهم المزعوم مع المحكمة الجنائية الدولية في التحقيقات التي تجريها حول العديد من الزعماء السياسيين السودانيين. وكان جهاز الأمن والمخابرات الوطني السوداني قد اعتقل المدافعين الثلاثة لمدة ثلاثة أيام، تعرضوا في خلالها للتعذيب ولسوء المعاملة.

En 2012, la Comisión Africana de Derechos Humanos y de los Pueblos (la Comisión) aceptó esta comunicación considerándola admisible para su evaluación. El caso fue presentado en nombre de tres defensores de los derechos humanos prominentes que trabajaban en Sudán: Monim Elgak, Amir Suliman y el fallecido Osman Hummaida, quienes eran perseguidos por su supuesta cooperación con la Corte Penal Internacional en su investigación de varios líderes políticos del Sudán.

In 2012, the African Commission on Human and People’s Rights (Commission) accepted this communication as admissible for consideration. The case was filed on behalf of three prominent human rights defenders working in Sudan, Monim Elgak, Amir Suliman and the late Osman Hummaida, who were targeted for their alleged cooperation with the ICC in its investigation of several Sudanese political leaders. The three men were arrested by Sudan’s National and Intelligence Services (NISS), tortured and maltreated for three days.
