Corte Interamericana concluye que hubo una violación del derecho a la salud en el contexto de servicios médicos de emergencia

El 17 de enero de 2001, Vinicio Poblete Vilches ingresó en el Hospital público chileno Sotero del Río con insuficiencia respiratoria grave. Tenía 76 años y fue enviado a la Unidad de Cuidados Intensivos (UCI), donde estuvo inconsciente durante varios días. Fue sometido a una cirugía, fue dado de alta y readmitido, y murió en el hospital el 7 de febrero.

Inter-American Court Finds Right to Health Violation in the Context of Emergency Medical Services

On January 17, 2001, Vinicio Poblete Vilches was admitted to the Chilean public Hospital Sotero del Rio with severe respiratory failure. La requérante, E.L., mère de quatre enfants âgée de 26 ans et vivant avec le VIH, a été accusée et condamnée en première instance au titre de la Section 192 du Code pénal malawien pour s’être livrée illicitement (par négligence) à un acte susceptible de propager une maladie mettant la vie en danger. L’accusation a fait valoir que la requérante avait « illicitement, négligemment et sciemment » allaité le bébé de la plaignante, qui avait été laissé à sa charge. Au moment de l’incident, E.L. était sous traitement antirétroviral (ARV).

أدانت المحكمة الابتدائية مستأنِفة الدعوى "إي أل" بموجب البند 192 من قانون العقوبات في ملاوي بتهمة التورط غير القانوني (عن طريق الإهمال) في عمل يُحتمل أن ينشر مرضًا يهدد الحياة. يُذكر أن مقدمة الطعن أم لأربعة أطفال لم تتجاوز الـ26 من العمر وهي مصابة بفيروس نقص المناعة البشرية. واستند الادعاء في اتهامه إلى حجة المستأنِفة أقدمت "عن علم وعن إهمال وعلى نحو غير مشروع" على إرضاع طفلها صاحب الشكوى، الذي تُرك لها أمر رعايته. وكانت "إي أل" تخضع لعلاجات مضادة للفيروسات الرجعية حين وقوع الحادث.

 

Un enfoque basado en los derechos humanos de la penalización de la exposición al VIH

La recurrente, E.L., de 26 años y madre de cuatro hijos que vivía con VIH, fue acusada y declarada culpable por el tribunal inferior bajo el artículo 192 del Código Penal de Malaui (el Código) por cometer ilegalmente (con negligencia) un acto que probablemente transmitiría una enfermedad que pone en peligro la vida. El fiscal argumentó que la recurrente le dio de mamar al bebé de la actora “de manera ilegal, negligente e intencional” mientras lo cuidaba. En el momento del incidente, E.L. recibía tratamiento antirretroviral (ART).

A human rights-based approach to the criminalization of HIV exposure

The appellant, E.L., a 26 year old mother of four living with HIV, was charged and convicted in the lower court under Section 192 of the Malawian Penal Code (Code) for unlawfully (negligently) engaging in an act likely to spread a disease dangerous to life. The prosecution argued that the appellant “unlawfully, negligently and knowingly” breastfed the complainant’s baby, who was left in her care. At the time of the incident, E.L. was on Anti Retro Treatment (ART).

El 23 de febrero de 2015, el presidente Kenyatta emitió una directiva nacional, que fue distribuida entre varias entidades gubernamentales nacionales, ordenando a todos los Comisionados de Condados recoger datos y preparar un informe sobre todos los niños que asisten a la escuela que viven con VIH y SIDA, así como sobre los guardianes, embarazadas y madres en etapa de lactancia que viven con VIH y SIDA.

Le 23 février 2015, le président Kenyatta a émis une directive nationale, dont une copie a été transmise à plusieurs entités gouvernementales nationales, ordonnant à tous les commissaires de comté de recueillir des données et d’élaborer un rapport sur tous les enfants scolarisés vivant avec le VIH et le sida, ainsi que sur les tuteurs et les femmes enceintes et allaitantes vivant avec le VIH et le sida.

في 23 شباط/فبراير 2015، أصدر الرئيس كينياتا توجيها وطنيا، أرسِلت نُسخ منه عدة جهات حكومية ووطنية، يأمر بمقتضاه جميع المفوضين في المقاطعات بجمع البيانات وإعداد تقرير عن كل الأطفال في سن المدرسة المتعايشين مع فيروس نقص المناعة البشرية والإيدز، كذلك عن أولياء الأمور والحوامل والأمهات المرضعات المتعايشين مع فيروس نقص المناعة البشرية والإيدز.

Data collection on children living with HIV must respect the right to privacy

On February 23, 2015, President Kenyatta issued a national directive, copied to several national government entities, ordering all County Commissioners to collect data and prepare a report on all school-going children living with HIV and AIDS, as well as guardians and expectant and breastfeeding mothers living with HIV and AIDS.
