En este Auto, la Corte se mostró gravemente preocupada por la amenaza que el desplazamiento interno suponía para la existencia de los pueblos indígenas en Colombia. La Corte atribuyó esta amenaza a tres factores principales: (1) ruptura de estructuras y desintegración comunitaria; (2) choque cultural fuera de sus tierras ancestrales; (3) quedar atrapados en medio de la violencia. 

In this Auto, the Court was gravely concerned with the threat that internal displacement posed to the existence of Indigenous Peoples in Colombia. The Court attributed this threat to three main factors: (1) rupture of structures and community disintegration; (2) culture shock outside of their ancestral lands; (3) getting caught in the middle of the violence. 

ينص القانون الدستوري الكولومبي على وجوب أن يحظى الأطفال بالأولوية في الرعاية وحماية حقوقهم. مع ذلك، تتجاوز نسبة الأطفال والمراهقين دون الثامنة عشر من العمر الخمسين من المئة من إجمالي السكان النازحين في كولومبيا. خلصت المحكمة في هذه القضية إلى أن استجابة الدولة كانت غائبة تمامًا وغير فعّالة في حل الانتهاكات العديدة لحقوق الأطفال. أولًا، لا يرى نظام مساعدة النازحين الحالي الأطفال على أنهم أصحاب حقوق، بل مستفيدين أو مُعالين من والديهم أصحاب الحقوق "الرسميين" لأغراض تلقي المساعدة الحكومية. وهذا ما يجعل وضعهم غير منظور.

En vertu du droit constitutionnel colombien, les enfants sont prioritaires en matière de soin et de sauvegarde de leurs droits. Or, plus de cinquante pour cent des personnes déplacées en Colombie sont des enfants et des adolescent·es de moins de 18 ans. Dans cette affaire, la Cour a caractérisé la réponse publique comme étant largement inexistante et inefficace pour résoudre les multiples violations des droits humains des enfants.

Según la legislación constitucional colombiana, los niños y niñas deben recibir prioridad en la atención y salvaguarda de sus derechos. A pesar de ello, más del cincuenta por ciento de la población desplazada en Colombia está compuesta por niños, niñas y adolescentes menores de 18 años. La Corte en este caso concluyó que la respuesta gubernamental ha sido en gran medida inexistente e ineficiente para resolver las innumerables violaciones de los derechos humanos de niños y niñas.

Under Colombian constitutional law, children must receive priority in care and safeguarding of their rights. Despite this, over fifty percent of the internally displaced population in Colombia is made up of children and adolescents below the age of 18. The Court in this case found that the governmental response has been largely inexistent and inefficient in resolving the myriad violations of childrens’ human rights.

قام أصغر ليغاري، وهو مزارع ومحامي، برفع دعوى قضائية ضد الحكومة الباكستانية بسبب تقاعسها عن مواجهة تغير المناخ، مدعيا أن هذا التقاعس و "التأخير وعدم الجدية" ينتهك الحقوق الأساسية للحياة التي ينص عليها الدستور، لأن تغير المناخ يشكل تهديدا خطيرا للمياه والغذاء وأمن الطاقة في باكستان. علاوة على ذلك، جادل ليغاري بأن "آثار تغير المناخ يمكن معالجتها من خلال التخفيف والتكيف. " 

Asghar Leghari, agriculteur et avocat, a poursuivi le gouvernement pakistanais pour inaction face au changement climatique, affirmant que cette inaction, ce « retard et ce manque de sérieux » violaient les droits fondamentaux à la vie prévus par la Constitution, puisque le changement climatique constituait une menace sérieuse pour la sécurité de l'eau, de la nourriture et de l'énergie au Pakistan. En outre, Leghari a fait valoir que « les effets du changement climatique peuvent être traités par l'atténuation et l'adaptation ». 

Asghar Leghari, agricultor y abogado, demandó al gobierno de Pakistán por su inacción frente al cambio climático, denunciando que tal falta de acción, “retraso y falta de seriedad” violaban los derechos fundamentales a la vida previstos por la Constitución, dado que el cambio climático representaba una amenaza seria para la seguridad del agua, la alimentación y la energía de Pakistán. Además, Leghari argumentó que los “efectos del cambio climático se pueden abordar mediante medidas de mitigación y adaptación”. 

Ashghar Leghari, a farmer and lawyer, sued the Pakistani government for inaction vis-a-vis climate change, claiming that this inaction, “delay, and lack of seriousness” violated the fundamental rights of life provided by the Constitution, since climate change posed a serious threat to water, food, and energy security in Pakistan. Further, Leghari argued the “effects of climate change can be addressed through mitigation and adaptation.”
