La Haute Cour du Botswana protège le droit d’un homme transgenre à avoir un document d’identité qui reflète son identité de genre

ND est un homme transgenre et son sexe attribué à la naissance était féminin. Etant donné que le  marqueur de genre figurant sur sa carte d’identité nationale ne correspondait pas au genre qu’il avait déclaré ni  à son identité de genre, le refus du gouvernement à changer son marqueur de genre lui a exposé à un stress émotionnel et à un inconfort extrêmes.

حُدد جنس ن.د.، وهو رجل مغاير الهوية الجنسانية، عند الولادة على أنه أنثى. ولما كان المؤشر الجنساني المذكور في بطاقة هوية ن.د. لا يتطابق مع هويتة الجنسانية أو نوع الجنس المعبّر عنه، أدى رفض الحكومة طلبه بتغيير المؤشر الجنساني إلى خضوعه لضغوط عاطفية مستمرة ومفرطة وتعرضه للمشقّة.

ND es un hombre transgénero a quien se le asignó el sexo femenino en el momento del nacimiento. Debido que el indicador de género del documento nacional de identidad de ND no coincidía con su género expresado o identidad de género, la negativa del gobierno de cambiar su indicador de género le exponía a estrés y malestar emocional continuo y extremo.

High Court of Botswana Protects Transgender Man’s Right to Have Identity Document Reflect His Gender Identity

ND is a transgender man, and his sex assigned at birth was female. Because the gender marker on ND’s national identity card did not match his expressed gender or gender identity, the refusal of the government to change his gender marker exposed him to ongoing and extreme emotional stress and discomfort.

En 2004, la Secretaría de Salud de Botswana distribuyó una directiva interna entre instituciones médicas públicas para informarles de un Decreto Presidencial que autorizaba “el suministro de tratamiento gratis a reclusos que no sean ciudadanos que sufran de enfermedades que no sean el SIDA”. Reclusos de Zimbabwe con VIH positivo presentaron demandas para cuestionar ea decreto después de que se les negaran medicamentos de una terapia antiretroviral (TAR).

In 2004 Botswana’s Secretary of Health circulated an internal directive to public medical facilities informing them of a Presidential Directive authorizing “provision of free treatment to non-citizen prisoners suffering from ailments other than AIDS.” HIV-positive Zimbabwean prisoners filed lawsuits challenging this directive after being denied free Anti-Retroviral Therapy (ARV).

En 1985, la empresa minera De Beers perforó un pozo con fines exploratorios y parte del agua fue provista a asentamientos ubicados dentro de la Reserva. Posteriormente, el gobierno desalojó y reubicó a la comunidad basarwa fuera de la Reserva, aduciendo que los asentamientos humanos no eran compatibles con la preservación de la fauna y flora. En un intento de disuadir a los basarwa de volver, también fue desmantelado el pozo de perforación, dado que era la única fuente de agua en un radio de 40 km a la redonda.
In 1985 De Beers mining company drilled a borehole for prospecting purposes and some of the water was supplied to settlements in CKGR. The Government later evicted and resettled the Basarwa outside of the CKGR because they felt that human settlements were incompatible with the conservation of wildlife in the preserve. In an attempt to dissuade the Basarwa from returning, the borehole was also dismantled as it was the only source of water within 40km. In 2006, in the Sesana case, the Court found that this eviction was unconstitutional and allowed the Basarwa to return to the CKGR.
