زعمت لجنة الحقوقيين الدولية والمجلس الأوروبي للاجئين والمنفيين أن الأطفال المهاجرين في اليونان والجزر اليونانية قد حُرموا من حقوقهم المكفولة بموجب الميثاق الاجتماعي الأوروبي المنقح (المشار إليه فيما يلي بـ "الميثاق"). وتشمل هذه الحقوق في السكن المتوافق مع كرامة الإنسان؛ الحماية الاجتماعية والقانونية والاقتصادية؛ الصحة؛ المساعدة الاجتماعية والطبية؛ والتعليم.

La Commission internationale de juristes (CIJ) et le Conseil européen pour les réfugiés et les exilés (CERE) ont allégué que les enfants migrants en Grèce et sur les îles grecques ont été privés de leurs droits qui sont garantis par la Charte sociale européenne révisée (ci-après « la Charte »). Ceux-ci incluent les droits à un logement compatible avec la dignité humaine, les protections sociales, juridiques et économiques, la santé, l’assistance sociale et médicale et l'éducation.

Las organizaciones International Commission of Jurists (ICJ) y European Council for Refugees and Exiles (ECRE) denunciaron que los niñes migrantes del territorio continental y las islas de Grecia han sido privados de sus derechos garantizados por la Carta Social Europea Revisada (en adelante, “la Carta”), los que incluyen los derechos a la vivienda compatible con la dignidad humana; garantías sociales, legales y económicas; salud; asistencia social y médica; y educación.

The International Commission of Jurists (ICJ) and the European Council for Refugees and Exiles (ECRE) alleged that migrant children in Greece and on the Greek islands have been deprived of their rights that are guaranteed within the Revised European Social Charter (hereinafter “the Charter”). These include the rights to housing compatible with human dignity; social, legal, and economic protections; health; social and medical assistance; and education.

Un ciudadano afgano (el Sr. M.S.S.) presentó una solicitud de asilo en Bélgica tras ingresar a la UE a través de Grecia. Conforme al Reglamento de Dublín (legislación de la UE que determina qué país es responsable de procesar solicitudes de asilo específicas), Bélgica lo trasladó nuevamente a Grecia para que Grecia procesara la solicitud de asilo. Grecia detuvo al solicitante bajo condiciones degradantes y luego lo liberó dentro del país para que espere hasta que se resuelva su solicitud. Durante este periodo, el Sr. M.S.S.

An Afghan citizen (Mr. M.S.S.) presented an asylum application in Belgium after entering the EU through Greece. Pursuant to the Dublin Regulations (EU law that determines which country has responsibility for processing specific asylum petitions), Belgium transferred him back to Greece in order for Greece to process the asylum petition. Greece detained the applicant in degrading conditions and then released him into the country to await a decision on his application. During this time, Mr. M.S.S. was homeless, not permitted to work, and had no access to sanitary facilities or any resources.

Este veredicto de la ECSR fue consecuencia de una denuncia colectiva recibida por el Centro Internacional para la protección de los Derechos Humanos (INTERIGHTS), miembros de la Red-DESC. Se alegaba que el gobierno griego violó el derecho a la vivienda de los romaníes en Grecia protegido según el artículo 16 de la ESC junto con el preámbulo de dicho documento que garantizaba su igualdad de derechos sociales como un medio para protegerlos contra la exclusión social.

This ECSR decision stemmed from a collective complaint lodged by the International Center for the Protection of Human Rights (INTERIGHTS), member of ESCR-Net, alleging that the Greek Government violated the right to housing of the Roma in Greece as protected under Article 16 of the ESC in conjunction with the Preamble of said Charter that guaranteed their equal access to social rights as a means to protect against their social exclusion.

Esta petición colectiva, presentada por el European Roma Rights Centre (ERRC), denunció que en Grecia se les negaba a los gitanos el derecho efectivo a la vivienda.  

El Comité sostuvo que la aplicación del artículo 16 respecto de los grupos nómades, incluyendo los gitanos itinerantes, implica que se les deben proveer lugares de asentamiento adecuados. En este sentido, el artículo 16 contiene obligaciones similares a las consagradas en el artículo 8 de la Convención Europea de Derechos Humanos.  

This collective complaint, made by the European Roma Rights Centre (ERRC), alleged that Roma in Greece were denied an effective right to housing.

The Committee held that the implementation of Article 16 with regard to nomadic groups, including itinerant Roma, implies that adequate stopping places should be provided. The Committee stated that, in this respect, Article 16 contains similar obligations to Article 8 of the European Convention of Human Rights.
