On 10 September, 2013, the High Court granted an eviction order “by agreement” of 184 unauthorized occupiers from a block of flats where they had been living for periods of up to 26 years. Only four of the 184 occupiers were present at the initial Court proceeding, accompanied by their unofficial ward committee representative, Mr. Skhulu Ngubane. The High Court both ordered the eviction of the occupiers, and, in parallel proceedings, refused to grant a rescission of this judgment. The case before the Constitutional Court was the rescission application.

La question en l’espèce était de savoir si le ministre de l’Éducation et huit provinces sud-africaines avaient l’obligation constitutionnelle et légale de fournir des repas quotidiens du NSNP aux élèves. Les plaignants incluaient Equal Education, une organisation juridique à but non lucratif de défense de l’éducation, et les organes de direction des écoles secondaires Vhulaudzi et Mashao.

En este caso se cuestionó si el Ministerio de Educación y ocho provincias sudafricanas tenían obligaciones constitucionales y legales de proveer las comidas diarias del NSNP a los alumnos. Los actores fueron Equal Education, una organización de defensa educativa sin fines de lucro y los órganos directivos escolares de dos instituciones: Vhulaudzi Secondary School y Mashao High School.

The issue in this case was whether the Minister of Education and eight South African provinces had constitutional and statutory duties to provide daily NSNP meals to learners. The plaintiffs included Equal Education, a nonprofit legal education advocacy organization and the school governing bodies of both Vhulaudzi Secondary School and Mashao High School.

Yolanda Daniels est une employée de maison et seule chef de famille qui a résidé pendant 16 ans dans une ferme. Elle a commencé à y vivre lorsque son ancien mari était employé par le propriétaire. Elle et ses trois enfants sont restés dans le logement avec le consentement du propriétaire après le divorce du couple.

Yolanda Daniels es una trabajadora doméstica y cabeza de familia que vivió durante 16 años en una vivienda rural. Comenzó a vivir allí cuando su ex marido era empleado del dueño. Después de divorciarse, permaneció con sus tres hijos en la vivienda con el consentimiento del dueño.

Yolanda Daniels is a domestic worker and sole head-of-household who resided for 16 years in a farm dwelling.  She began living there when her former husband was employed by the owner.  She and her three children remained in the dwelling with the owner’s consent after the couple divorced.

منذ أكثر من 20 عاما، وعدت مدينة جوهانسبرغ السكان بأنها ستعمل على تحسين أوضاع سلوفو بارك إزاء نقص الكهرباء، إمدادات كافية من المياه، الصرف الصحي، إزالة القمامة، ترسيم حدود الطرقات، وعرضة الأكواخ للحرائق المميتة.   تقاعس المدينة دفع السكان إلى تطوير خطط خاصة بهم لتحسين الأوضاع بما يتفق مع سياسة ترقية الأحياء الفوضوية (UISP) الواردة ضمن قانون الإسكان الوطني. بالرغم من جهود السكان لإشراك البلدية في تنفيذ هذه الخطط، إلا أن البلدية كانت غير متجاوبة.
