Asghar Leghari, agriculteur et avocat, a poursuivi le gouvernement pakistanais pour inaction face au changement climatique, affirmant que cette inaction, ce « retard et ce manque de sérieux » violaient les droits fondamentaux à la vie prévus par la Constitution, puisque le changement climatique constituait une menace sérieuse pour la sécurité de l'eau, de la nourriture et de l'énergie au Pakistan. Ashghar Leghari, a farmer and lawyer, sued the Pakistani government for inaction vis-a-vis climate change, claiming that this inaction, “delay, and lack of seriousness” violated the fundamental rights of life provided by the Constitution, since climate change posed a serious threat to water, food, and energy security in Pakistan. Further, Leghari argued the “effects of climate change can be addressed through mitigation and adaptation.”

En 2022, la Commission philippine des droits de l'homme (ci-après « la Commission ») a publié les résultats d'une enquête de sept ans sur les effets du changement climatique aux Philippines et sur le devoir des États et des acteurs privés de faire face à « la fréquence et la gravité croissantes des catastrophes naturelles ».

Cette affaire est un recours collectif intenté par Milieudefensie, Greenpeace NL, Fossielvrij NL, Waddenvereniging, Both ENDS et Young Friends of the Earth NL qui ont poursuivi le défendeur Royal Dutch Shell devant le tribunal de district de La Haye. Les plaignants ont demandé une décision selon laquelle RDS - société mère de Shell - doit réduire ses émissions de gaz à effet de serre (GES) de 45 % d'ici 2030 par rapport aux niveaux de 2019, et à zéro d'ici 2050, conformément à l'Accord de Paris.
