Comité de DESC de la ONU aborda el impacto del trabajo de cuidados no remunerado sobre el acceso de la mujer a la seguridad social

Marcia Cecilia Trujillo Calero hizo aportes jubilatorios equivalentes a 29 años de trabajo al Instituto Ecuatoriano de Seguridad Social (IESS). De los 305 aportes que hizo, aproximadamente la mitad fueron aportes voluntarios efectuados entre 1981 y 1995, cuando realizaba el trabajo de cuidados no remunerado en su hogar, cuidando de sus tres hijos. Durante un período de ocho meses iniciado en 1989, la Sra. Trujillo interrumpió sus pagos voluntarios, aunque los pagó completamente en forma retroactiva en abril de 1990.

UN Committee on ESCR addresses the impact of unpaid care work on women’s social security access

Marcia Cecilia Trujillo Calero made 29 years’ worth of retirement contributions to the Ecuadorian Institute of Social Security (IESS). The Sarayaku people form one of the oldest settlements of the Kichwa People in the province of Pastaza in the Ecuadorian Amazon, and include approximately 1,300 people. In 1996, Ecuador signed a contract with the Empresa Estatal de Petróleos del Ecuador (PETROECUADOR) and a group formed with CGC (Compañía General de Combustibles, a subsidiary of Chevron, in Argentina) and la Petrolera Ecuador San Jorge S.A. for oil exploration and exploitation in Sarayaku lands.

Centro de Derechos Económicos y Sociales (CDES), on behalf of the General Secretary of Sindicato Nacional de Trabajadores del Ministerio de Salud [National Union of Health Ministry Workers] and the workers represented by the union, filed a report with the Inter-American Commission of Human Rights (IACHR) against the State of Ecuador.

El Centro de Derechos Económicos y Sociales (CDES), en representación del Secretario General del Sindicato Nacional de Trabajadores del Ministerio de Salud y de los trabajadores afiliados, denunció ante la CIDH al Estado ecuatoriano, por incumplir la obligación de desarrollo progresivo de los derechos económicos, sociales y culturales, prevista en la Convención Americana sobre Derechos Humanos. Este incumplimiento radicaba en las reducciones sistemáticas del presupuesto nacional en materia de salud y su consecuente impacto en la salud y la vida de los grupos más vulnerables de la sociedad.

In its 39th session (May 16-June 3 2005), the Committee on the Rights of the Child, the supervisory body of the International Convention on the Rights of the Child (CRC), issued its opinion on a possible incompatibility between the CRC and the standards in the free trade agreement being negotiated by Ecuador, Colombia and Peru, and the U.S. The Committee expressed concern about the possibility that the proposed intellectual property standards undermine the State's ability to ensure access to low cost drugs and to fulfill its obligations under international human rights law.

On April 27, 1998, oil company Arco Oriente Inc. signed an hydrocarbon development agreement with Ecuador. Although 70% of the land belonging to Federación Independiente del Pueblo Shuar del Ecuador (FIPSE) was within the area to be devoted to the project, its members were not notified of the terms of the agreement or the related environmental impact. FIPSE, in a Special Meeting of its members, decided to prohibit all individual negotiations or agreements by FIPSE Member Centers or Associations with the company. This was notified to both the State and the company.

El 27 de abril de 1998, la compañía petrolera Arco Oriente Inc. firmó con Ecuador un contrato de explotación de hidrocarburos. Si bien el 70% del territorio de la Federación Independiente del Pueblo Shuar del Ecuador (FIPSE) se encontraba dentro de la superficie afectada a la explotación, sus miembros no fueron notificados del contenido del contrato ni de los efectos ambientales de la actividad.

En su 39º período de sesiones, celebrado entre el 16 de mayo y el 3 de junio de 2005, el Comité de Derechos del Niño –órgano de supervisión de la Convención Internacional sobre Derechos del Niño (CIDN)- se pronunció sobre la eventual incompatibilidad entre la CIDN y las normas del tratado de libre comercio que Ecuador, junto a Colombia y Perú se encuentran negociando con los Estados Unidos.
