Este caso se refiere al arrendamiento de tierras tribales con fines de minería e industriales. El Estado de Andhra Pradesh otorgaba contratos de arrendamiento a varias personas ajenas a la tribu para que realizaran actividades de minería en tierras tribales.

This case concerns the leasing of tribal lands for mining and industrial purposes.  The State of Andhra Pradesh granted leases to several non-tribal persons to mine tribal lands.  Samatha, a group representing the rights of affected tribal persons, filed a petition in the High Court of Andhra Pradesh arguing that the granting of leases to tribal lands to non-tribal persons for mining purposes violated the Andhra Pradesh Scheduled Areas Land Transfer Regulation (1959) and the Forest Conservation Act (1980).  The petition was rejected by the High Court and Samatha subsequently appealed to the

 

تتناول هذه القضية إلتزامات بلدية راتلام تجاه مواطنيها بموجب المادة 123 من قانون البلديات في ولاية ماديا براديش لعام 1961. تشمل هذه الالتزامات توفير المرافق الصحية والحؤول دون تلوّث الشوارع من مصنع كحول مجاور. فقد عمد سكان بلدية راتلام بعد أن أصابهم الإحباط من غياب المرافق الصحية وتلوث الشوارع، إلى رفع دعوى على البلدية بموجب المادة 133 من قانون الاجراءات الجنائية لتسببها بالأذى العام. قالت البلدية إن 1) السكان اختاروا العيش في مكان يخلو من المرافق، 2) وإن السلطات تنقصها الأموال اللازمة لبناء ما هو مطلوب لتلبية الالتزامات.

Cette affaire concerne les obligations de la Municipalité de Ratlam à l’égard de sa population au titre de la Section 123 de la M. P. Municipalities Act of 1961.  Ces obligations comprennent la fourniture d’installations sanitaires et la prévention de la pollution des rues causée par une usine de production d’alcool située à proximité.

Este caso se refiere a las obligaciones del municipio de Ratlam para con su pueblo establecidas en la Sección 123 de la Ley de Municipios M. P. de 1961. Estas obligaciones incluyen la concesión de instalaciones sanitarias y la prevención de la contaminación de las calles causada por una planta de alcohol cercana. Los residentes del municipio de Ratlam, frustrados por la falta de instalaciones sanitarias y por la contaminación de las calles, interpusieron una demanda contra el municipio en virtud de la Sección 133 del Código de Procedimiento Penal por delito de perjuicio público.

This case concerns the Ratlam municipality’s obligations to its people under Section 123 M. P. Municipalities Act of 1961. These obligations include the provision of sanitary facilities and the prevention of street contamination from a nearby alcohol plant. The residents of the Ratlam municipality, frustrated at the lack of sanitary facilities and the contamination in the streets, brought suit against the municipality under Section 133 of the Criminal Procedure Code for public nuisance.

Gurulingappa Savadi era el cabeza de una familia india conjunta (intergeneracional) que murió en 2001. En 2002, su nieto presentó una demanda para dividir la propiedad familiar, alegando que sólo la viuda y los dos hijos de Savadi eran copropietarios de la propiedad después de la muerte de Savadi.

Indian Supreme Court upholds gender equality in inheritance law

Gurulingappa Savadi was the head of a Hindu joint (intergenerational) family who died in 2001. In 2002, his grandson brought a suit to partition the family property, alleging that only Mr. Savadi’s widow and two sons were co-owners of the property upon Mr. Savadi’s death. The suit asserted that Mr. Savadi’s two married daughters were not entitled to any share of the property, since they were born prior to the Hindu Succession Act (codified customary/personal law), and therefore could not be treated as coparceners (persons who share jointly with others in an inheritance).
