منظمة Techo في المكسيك ضد المعهد الوطني للإحصاءات والجغرافيا، مراجعة الحماية المؤقتة 635/2019.

زعمت صاحبة الشكوى، منظمة Techo في المكسيك، أن المعهد الوطني للإحصاء والجغرافيا (INEGI) فشل في جمع بيانات التعداد الخاصة ب التجمعات السكنية العشوائية. ووفقًا لمنظمة Techo، أدى هذا الفشل إلى عدم إعمال الدولة للحق في السكن الملائم لأن سياسات الدولة وصنع السياسات تعتمد على المعلومات الإحصائية التي تم جمعها في التعداد. وأكدت المحكمة أن فشل المعهد الوطني للإحصاء في جمع ونشر المعلومات الإحصائية عن التجمعات السكنية العشوائية أدى إلى افتراض عدم الدستورية الذي وضع عبء الإثبات على عاتق المعهد الوطني للإحصاء.

Un Techo para mi País Mexique c. Institut national de statistiques et de géographie, amparo en cours d'examen 635/2019

Le requérant, Un Techo para mi País México (Techo), affirmait que l’Institut national de statistique et de géographie (INEGI) n’avait pas recueilli de données de recensement sur les quartiers informels. Selon Techo, ce manquement a entraîné la non-réalisation par l’État du droit à un logement convenable, car les politiques et l’élaboration des politiques de l’État dépendent des informations statistiques recueillies lors du recensement.

El demandante, Un Techo para mi País México (Techo), arguyó que el Instituto Nacional de Estadística y Geografía (INEGI) no recabó datos censales acerca de los asentamientos informales. Según Techo, esto provocó que el Estado no respetase el derecho a una vivienda digna, puesto que las políticas estatales dependen de los datos estadísticos recabados por el censo. La Corte afirmó que el hecho de que el INEGI no hubiese recogido y publicado datos estadísticos sobre los asentamientos informales creaba una presunción de inconstitucionalidad que situaba la carga de la prueba en el INEGI.

The complainant, Un Techo para mi País México (Techo), claimed that the National Institute of Statistics and Geography (INEGI) failed to collect census data for informal settlements. According to Techo, this failure resulted in the State’s non-realization of the right to adequate housing because State policies and policymaking depend on statistical information gathered in the census. The Court affirmed that the INEGI’s failure to collect and disseminate statistical information on informal settlements created a presumption of unconstitutionality that put the burden of proof on INEGI.

En el año 2010 el Estado Mexicano impulsó la construcción y operación del proyecto llamado “Acueducto Independencia”, el cual pretende trasvasar desde la presa “El Novillo” (en la cuenca del Río Yaqui) alrededor de 60 millones de metros cúbicos de agua hasta la cuenca del Río Sonora, para la ciudad de Hermosillo, Sonora.
