Shelter Residents Successfully Challenge Rules on Family Separation and Lockout

This case grew out of the 2011 judgment in Blue Moonlight, where the Constitutional Court of South Africa held that municipalities have a constitutional obligation to provide temporary emergency accommodation to all evictees who would be rendered homeless.

المدّعون هم العمال ذوو الدخل المنخفض الذين حصلوا على قروض صغيرة من شركة القروض. في وقت لاحق، وحينما تخلفوا عن تسديد الدفعات المستحقة في مواعيدها،  طالبتهم الشركة بتوقيع وثائق إضافية، كان من نتائجها إقدام الكتّاب في أقلام محاكم الصلح البعيدة من مقر إقامة المدّعين وأماكن عملهم، على تسطير أحكام غيابية وأوامر بحجز أجورهم لصالح مقدمّي الدين، ما حال دون تمكنهم من الاعتراض على هذه الأوامر. وفي بعض الحالات زُوِّرت تواقيع العمال التي تخوّل مقدّم الدين استصدار أوامر بحجز أجور الموقعين. إن المبالغ الهائلة المقتطعة من أجور المدينين تركتهم من غير دخل كاف لإعالة أنفسهم وإعالة أسرهم.

Los solicitantes eran trabajadores de bajos ingresos que habían obtenido pequeños préstamos de una compañía de préstamos. Cuando, posteriormente, no pudieron cumplir con las cuotas de pago de los préstamos, la compañía exigió que firmaran otros documentos que hacían posible que las prestadoras obtuvieran fallos por incumplimiento y órdenes de embargo salarial (OES) otorgadas por secretarios de tribunales de primera instancia ubicados lejos de donde residían y trabajaban los actores.

Constitutional Court case focused on judicial oversight of debt recovery practices in South Africa

The applicants were low-income workers who had obtained small loans from a loan company. When they later became unable to keep up with loan repayments, the company demanded that they sign further documents which resulted in default judgments and emoluments attachment orders (EAOs) being obtained by credit providers, from clerks of magistrates’ courts located far away from where the applicants reside and work, making it very difficult to oppose these orders. In some instances, their signatures that enabled the credit provider to obtain the EAOs were forged.

في عام 2012، بدأت وزارة التعليم الأساسي، في مسعى منها لتوحيد التعليم في أرجاء البلاد، مرحلة تمهيدية تمتد على ثلاث سنوات يُنشر في خلالها منهاج دراسي جديد ينطوي على إدخال تدريجي للكتب المدرسية الجديدة. بيّد أنه على الرغم من النجاح المُحرز في المحافظات الأخرى، عجزت الحكومة الإقليمية عن تسليم الكتب المدرسية إلى جميع التلاميذ مع بداية العام الدراسي 2012.

Caso ante el Alto Tribunal

En 2012, intentando estandarizar la educación en todo el país, el Ministerio de Educación Básica (MEB) inició un proceso de tres años destinado a introducir un nuevo plan de estudios que incluía la introducción escalonada de nuevos libros de texto. A pesar de que en otras provincias el plan se introdujo sin problemas, en Limpopo el gobierno provincial no pudo entregar libros de texto a todos los alumnos para el inicio del año lectivo 2012.

High Court case

In 2012, seeking to standardize education nationwide, the Department of Basic Education (DBE) began the three-year rollout of a new curriculum which entailed staggered introduction of new textbooks. Despite the successful rollout in other provinces, in Limpopo the Provincial Government was unable to deliver textbooks to all learners by the start of the 2012 school year.

En este caso, un propietario solicitó ante el Alto Tribunal (High Court) que se descarte una decisión del Tribunal de Viviendas Arrendadas de Gauteng. Ochenta inquilinos habían presentado una demanda ante dicho tribunal cuestionando que el propietario cobraba aproximadamente 385 rands por mes por inquilino en concepto de electricidad además de los costos que pagaban por su consumo individual.

In this case, a landlord applied for the High Court to set aside a decision by the Gauteng Rental Housing Tribunal (“Tribunal”). Eighty rental tenants had brought a complaint to the Tribunal based on their landlord’s charge of about R385 per month per tenant for electricity in addition to the costs they paid for their individual consumption. The tenants discovered that the utility service provider, City Power, charged the landlord about R337,50 per month for the whole building. This meant that their landlord was generating a significant profit from the service charge.
