The Paraguayan justice rules in favor of the Sawhoyamaxa community

The Constitutional Chamber of the Supreme Court unanimously rejected the unconstitutionality claim presented against Law No. 5194/14, which expropriated 14,404 hectares of land in favor of the Sawhoyamaxa community. 

This landmark judgment, which was issued by Supreme Court Justices Victor Nunez, Gladys Bareiro Fretes and Antonio Modica, supports the implementation of the 2006 Decision of the Inter-American Court of Human Rights which established that the State of Paraguay should restitute the traditional lands of the Sawhoyamaxa Community. 

The organization Tierraviva in Paraguay has spent years defending the rights of the Sawhoyamaxa and is responsible for litigating the case before the Supreme Court.
