محكمة كنساس العليا تحكم بضرورة أن يتحرى تمويل المدارس المساواة والملائمة

في 2010 قامت 4 إدارات تعليمية بولاية كنساس و31 طالباً وأوصيائهم برفع قضية على ولاية كنساس بدعوى أن الخصم من ميزانيات المدارس العامة بداية من 2009 قد أدى إلى عدم ملائمة تمويل المدارس بسبب عدم عدالة توزيع التمويل على المدارس المختلفة، في مخالفة للمادة 6 من دستور ولاية كنساس (مواد تنظيم التعليم) والقوانين الخاصة بالولاية، وإجراءات التقاضي السليمة، فضلاً عن مخالفة المواد الخاصة بالمساواة في منح الحماية بدستوري ولاية كنساس والدستور الأمريكي.

Kansas Supreme Court decides school funding should be equitable and adequate

In 2010, four Kansas school districts, 31 students, and their guardians sued the State of Kansas alleging that cuts in public school budgets beginning in 2009 had left schools inadequately funded and that portions of the funding were inequitably distributed, in violation of Article 6 of the Kansas Constitution (regulating education provision), state statutes, and due process and equal protection clauses of the Kansas and United States Constitutions.

In 2004 Botswana’s Secretary of Health circulated an internal directive to public medical facilities informing them of a Presidential Directive authorizing “provision of free treatment to non-citizen prisoners suffering from ailments other than AIDS.” HIV-positive Zimbabwean prisoners filed lawsuits challenging this directive after being denied free Anti-Retroviral Therapy (ARV).

The Mental Disability Advocacy Center brought a complaint before the European Committee of Social Rights (which judges compliance of State parties with the European Social Charter) alleging that children living in homes for mentally disabled children (HMDCs) in Bulgaria received little to no education.

In 2005, under the Article 26 procedure of the Constitution, the Irish Supreme Court reviewed the constitutionality of a bill referred to it by the President. This bill authorized charges for in-patient services, provided by the public health service, to be imposed on certain people, in most cases, elderly people of limited means.

In 2006, Asociación Civil por la Igualdad y la Justicia (ACIJ), an organization member of the ESCR-Net, filed an amparo action against the Government of the City of Buenos Aires. The purpose of the action was to have the Court order the Government to comply with its existing constitutional obligation to ensure and finance access to early education. The case centered on violations of the right to education and to equality, as well as the principle of personal autonomy.
