La ONU ve violación de derechos en negativa de atención médica esencial a migrante irregular

Nell Toussaint cuestionó que Canadá les negara cobertura de salud a los inmigrantes indocumentados bajo el programa federal de atención médica para inmigrantes, llamado Interim Federal Health Benefit Program. Tras agotar los recursos nacionales, Toussaint presentó su reclamo ante el Comité de Derechos Humanos de Naciones Unidas (el Comité) bajo el procedimiento facultativo de comunicaciones (primer protocolo facultativo) del Pacto Internacional de Derechos Civiles y Políticos, el cual fue ratificado por Canadá en 1976.

UN finds rights violations in irregular migrant being denied essential health services

Nell Toussaint challenged Canada’s denial of health care coverage to undocumented immigrants under the under the federal government’s program of health care to immigrants, called the Interim Federal Health Benefit Program. After exhausting domestic remedies, Toussaint brought her claims to the United Nations Human Rights Committee (Committee) under the optional complaints procedure (first optional protocol) to the International Covenant on Civil and Political Rights, which Canada ratified in 1976.

Une approche de la criminalisation de l'exposition au VIH fondée sur les droits humains

La requérante, E.L., mère de quatre enfants âgée de 26 ans et vivant avec le VIH, a été accusée et condamnée en première instance au titre de la Section 192 du Code pénal malawien pour s’être livrée illicitement (par négligence) à un acte susceptible de propager une maladie mettant la vie en danger. L’accusation a fait valoir que la requérante avait « illicitement, négligemment et sciemment » allaité le bébé de la plaignante, qui avait été laissé à sa charge. Au moment de l’incident, E.L. était sous traitement antirétroviral (ARV).

أدانت المحكمة الابتدائية مستأنِفة الدعوى "إي أل" بموجب البند 192 من قانون العقوبات في ملاوي بتهمة التورط غير القانوني (عن طريق الإهمال) في عمل يُحتمل أن ينشر مرضًا يهدد الحياة. يُذكر أن مقدمة الطعن أم لأربعة أطفال لم تتجاوز الـ26 من العمر وهي مصابة بفيروس نقص المناعة البشرية. واستند الادعاء في اتهامه إلى حجة المستأنِفة أقدمت "عن علم وعن إهمال وعلى نحو غير مشروع" على إرضاع طفلها صاحب الشكوى، الذي تُرك لها أمر رعايته. وكانت "إي أل" تخضع لعلاجات مضادة للفيروسات الرجعية حين وقوع الحادث.

 

Un enfoque basado en los derechos humanos de la penalización de la exposición al VIH

La recurrente, E.L., de 26 años y madre de cuatro hijos que vivía con VIH, fue acusada y declarada culpable por el tribunal inferior bajo el artículo 192 del Código Penal de Malaui (el Código) por cometer ilegalmente (con negligencia) un acto que probablemente transmitiría una enfermedad que pone en peligro la vida. El fiscal argumentó que la recurrente le dio de mamar al bebé de la actora “de manera ilegal, negligente e intencional” mientras lo cuidaba. En el momento del incidente, E.L. recibía tratamiento antirretroviral (ART).

A human rights-based approach to the criminalization of HIV exposure

The appellant, E.L., a 26 year old mother of four living with HIV, was charged and convicted in the lower court under Section 192 of the Malawian Penal Code (Code) for unlawfully (negligently) engaging in an act likely to spread a disease dangerous to life. The prosecution argued that the appellant “unlawfully, negligently and knowingly” breastfed the complainant’s baby, who was left in her care. At the time of the incident, E.L. was on Anti Retro Treatment (ART).

في شباط/فبراير 2016، وضعت امرأة من الروما مولودها في مستشفى حكومي في ميشكوليتس، شمال شرق هنغاريا. وأثناء المخاض كانت تصرخ من الألم فصاحت القابلة بها وهددتها قائلة "إن صرخت مجددًا سأضع الوسادة على وجهك". لكن حينما اعتذرت المرأة من الطبيبة، هددتها مجددًا قائلة " إن صرخت مرة أخرى سأستدعي الطبيب بنفسي ليسلب منك الطفل وبعد ذلك ستحرمين من إعانة الطفل، لأنكم أنتم الغجر تنجبون الأطفا طمعًا بالأموال ليس إلا"!

La Hongrie protège le droit des femmes roms à l'égalité dans les établissements de santé

En février 2016, une femme rom a accouché dans un hôpital public à Miskolc, dans le Nord-Est de la Hongrie.  Pendant l’accouchement, elle a crié de douleur et la sage-femme lui a crié « si tu hurles encore une fois, je te pousse l’oreiller dans le visage. » Quand la femme s’est excusée, le médecin lui a dit : « si tu avais crié une fois de plus, j’aurais appelé le psychiatre pour qu’il emporte ton enfant et tu n’aurais pas reçu la prestation pour enfant, car de toute façon, vous les gitans, vous ne donnez naissance que pour l’argent ! »

Hungría defiende el derecho de las mujeres romaní a la igualdad en las instituciones de salud

En febrero de 2016, una mujer romaní dio a luz en un hospital público de Miskolc, al nordeste de Hungría. Mientras gritaba de dolor durante el parto, la partera le gritó “si vuelves a gritar te tapo la cara con la almohada”. Cuando la mujer pidió disculpas, el médico le dijo: “si hubieras gritado otra vez hubiera llamado al psiquiatra para que te quiten el bebé y no recibirías beneficios por hijo, porque, igual, ¡ustedes las gitanas solo vienen a parir por el dinero!”.

Hungary upholds Romani women’s right to equality in health institutions

In February 2016, a Romani woman gave birth a public hospital in Miskolc, north-eastern Hungary. During labour she cried out with pain and the midwife yelled at her “if you shout once more I will push the pillow into your face”. When the woman apologised, the doctor said to her “if you had shouted once more I would have called the psychiatrist to take away child away and then you wouldn’t receive Child Benefit, because anyway, you gypsies give birth only for the money!”
