High Court case

In 2012, seeking to standardize education nationwide, the Department of Basic Education (DBE) began the three-year rollout of a new curriculum which entailed staggered introduction of new textbooks. Despite the successful rollout in other provinces, in Limpopo the Provincial Government was unable to deliver textbooks to all learners by the start of the 2012 school year.

En este litigio de interés público, presentado a través del artículo 32 de la Constitución de la India en forma directa ante la Corte Suprema del país, se solicitó a la Corte que ordene al estado de Uttar Pradesh tomar medidas para poner fin al trabajo de menores.

Mental Disability Advocacy Center presentó ante el Comité Europeo de Derechos Sociales (que juzga el cumplimiento de los Estados de la Carta Social Europea) una demanda para denunciar que los niños que viven en hogares para niños con discapacidades mentales de Bulgaria no reciben educación o, en todo caso, muy poca.

El caso fue presentado por niños desfavorecidos que necesitaban vivienda y tratamiento en unidades de apoyo intensivo. Los niños afirmaron que el estado tenía la obligación constitucional de proporcionarles cuidados especiales e instalaciones educativas apropiadas. El estado coincidió en que tales instalaciones eran necesarias y afirmó que había iniciado el proceso de planificación para construirlas. Sin embargo, los proyectos sufrieron numerosos retrasos administrativos y logísticos.

El consorcio Juma Masjid Trust le había permitido a la escuela primaria Juma Musjid, una escuela pública, utilizar su propiedad privada por un período prolongado. La disputa surgió cuando el Departamento de Educación Provincial responsable de la escuela no pagó el alquiler o gastos varios necesarios para el funcionamiento de la escuela, y tampoco respondió adecuadamente a una notificación y otras comunicaciones enviadas por el consorcio solicitando que se evacuara el edificio.

En 1993, la organización Campaign for Fiscal Equity (CFE), junto con varios alumnos y sus padres, presentaron una demanda afirmando que el sistema de financiación educativa del Estado de Nueva York violaba la constitución estatal al no proporcionar a los alumnos de las escuelas públicas de la ciudad de Nueva York la oportunidad de obtener una educación básica de buena calidad.

This public interest litigation case (PIL) was filed via Article 32 of the Indian Constitution directly before the Supreme Court of India and petitioned the Court to direct the State of Uttar Pradesh (UP) to take steps to end child labor. Thereafter a Court-appointed committee reported the enormity of child exploitation in UP’s carpet industry, finding that many children were kidnapped from Bihar, that the industry largely employed minor children under 14 years, and that many experienced physical abuse. 

The Juma Masjid Trust had allowed the Juma Musjid Primary School, a public school, to operate on its private property for an extended period of time. A dispute arose when the provincial Department of Education responsible for the school did not pay the Trust for rent or out-of-pocket expenses to run the school, and also did not adequately respond to a notice and other communications from the Trust to vacate the premises. The Trust then sought an eviction order to remove the School from its property.

The Mental Disability Advocacy Center brought a complaint before the European Committee of Social Rights (which judges compliance of State parties with the European Social Charter) alleging that children living in homes for mentally disabled children (HMDCs) in Bulgaria received little to no education.
