Petitioners challenged the 2009 decision of the State of Massachusetts to exclude a group of legal immigrants from its Commonwealth Care Health Insurance Program. Plaintiffs alleged that such exclusion violated the Equal Protection Clause recognized by the Constitution of Massachusetts.

Este caso del Tribunal Supremo fue iniciado con el apoyo de Hakijamii, una organización de derechos humanos con sede en Nairobi que es miembro de la Red-DESC desde 2005. La demandante, Sra. N, ciudadana ugandesa, entró en el Reino Unido en marzo de 1998. Estaba gravemente enferma y fue diagnosticada con VIH. Completó una solicitud de asilo a los pocos días, alegando que había sido violada por el Movimiento de Resistencia Nacional en Uganda debido a su asociación con el Ejército de Resistencia del Señor (Lord's Resistance Army). This High Court case was brought with the support of Hakijamii, a human rights organization based in Nairobi that has been a member of ESCR-Net since 2005; and stemmed from the request of more than 1,000 individuals, evicted from their homes located in six communities commonly known as the Medina Location of Garissa municipality.

The applicant, Ms. N, a Ugandan national, entered the UK in March 1998. She was seriously ill and was diagnosed as HIV positive. She completed an asylum application within a few days, claiming she had been raped by the National Resistance Movement in Uganda because of her association with the Lord's Resistance Army. In August 1998, Ms. N developed Kaposi's sarcoma. In March 2001, a physician prepared an expert report which expressed that without regular antiretroviral treatment and monitoring, the applicant's life expectancy would be less than one year.

The plaintiff filed an injunction aimed at guaranteeing the right of a 12 year-old girl to her mental health, among other rights. The girl became pregnant in early 2011 and started presenting symptoms of anxiety and depression, as diagnosed by different physicians, who recommended the interruption of her pregnancy.

La demandante interpuso una orden de interdicto o tutela dirigida a garantizar el derecho de una menor de 12 años a su salud mental, entre otros derechos. La menor quedó embarazada a principios de 2011 y empezó a presentar síntomas de ansiedad y depresión, según el diagnóstico de varios médicos que recomendaron la interrupción del embarazo.

Alyne Pimentel, una mujer afrobrasileña, murió a los 28 años como consecuencia de complicaciones relacionadas con un embarazo después de que un centro de salud de Rio de Janeiro no le proporcionara acceso adecuado y oportuno a tratamiento obstétrico de emergencia. La muerte de Pimentel hubiera podido ser impedida si el centro de salud le hubiera diagnosticado y tratado correctamente por muerte fetal intrauterina.

Alyne Pimentel, an Afro-Brazilian woman, died at 28 years old of complications resulting from her pregnancy, after a health center in Rio de Janeiro failed to provide for appropriate and timely access to emergency obstetric care. Pimentel's death could have been prevented, if the health center had correctly diagnosed and treated her for intrauterine fetal death. Pimentel's death is not an isolated case.
