South Africa: Stop the murders, detentions and threats against shack dwellers

On 10 October, 2013, ESCR-Net sent an Urgent Action appeal in response to the recent murders, arbitrary detentions, intimidation and threats against leaders of the shack-dweller movement and ESCR-Net member, Abahlali baseMjondolo and called on the Government of South Africa to uphold its human rights obligations.

ESCR-Net letter to the Coordinating Committee of Special Procedures

On 23 September, ESCR-Net sent a letter to the Coordinating Committee of Special Procedures to express concern regarding statements issued by members of the parliament (MPs) of the United Kingdom following a preliminary report from an official mission to that country by the Special Rapporteur on adequate housing, Raquel Rolnik.

European Roma Rights Centre v. Portugal (Complaint No. 61/2010)

The Committee analyzed three issues regarding the right of Roma to housing in Portugal: the “precarious and difficult housing conditions for a large part of the Roma community”; “the high number of Roma families that live in segregated settings”; and “the inadequacy of re-housing programmes for the Roma community in terms of their family composition, cultural habits and ways of life”.

Ntombizodwa Yvonne Maphango and others v. Aengus Lifestyle Properties PTY Ltd, CCT 57/11 [2012] ZACC 2

This case concerns the attempted eviction of tenants of certain residential flats in Johannesburg. These tenants had been living in these flats subject to various leases, some for nearly twenty years. The leases contained a provision allowing either party to terminate the lease with certain notice. Three years before the attempted evictions the landlord told the tenants to pay double or triple their rent or leave their homes. When the tenants refused, the landlord terminated their leases.

Advancing ESCR in Mongolia and China – Lawyers, community leaders and academics gathered for strategic litigation workshops

On April 17-19, 2013, ESCR-Net and the Center for Human Rights and Development brought together lawyers, experts, and community leaders from Mongolia to enhance knowledge about the Optional Protocol to the ICESCR; build networks of solidarity and support among lawyers and activists and support Mongolian organizations to identify potential cases that could be advanced under the OP-ICESCR.

International Centre for the Legal Protection of Human Rights (INTERIGHTS) v. Greece Complaint No. 49/2008

This ECSR decision stemmed from a collective complaint lodged by the International Center for the Protection of Human Rights (INTERIGHTS), member of ESCR-Net, alleging that the Greek Government violated the right to housing of the Roma in Greece as protected under Article 16 of the ESC in conjunction with the Preamble of said Charter that guaranteed their equal access to social rights as a means to protect against their social exclusion.

Disability Advocates, Inc. v. David A. Paterson and Others, 653 F.Supp.2d 184 (2009)

Disability Advocates, Inc. (DAI) brought a suit before the U.S. District Court (NY) asserting that New York State discriminated against individuals with disabilities in violation of the ADA’s integration mandate, which requires that individuals with mental illness residing in adult care facilities in New York receive services in the most integrated setting possible in order to increase interaction with the broader community.
