The Higher Social Court of North Rhine-Westphalia asked the German Federal Constitutional Court to decide whether the cash benefits for asylum seekers provided under section 3 paragraph 2 of the Asylum Seekers Benefit Act comply with the constitutional right to a minimum standard of living.

The decision holds Italy accountable for policies and practices that have resulted in Roma and Sinti residents living in segregated and grossly inadequate housing conditions, as well as forced eviction of entire communities and expulsion of migrant Roma from Italy.  The case also held Italy accountable for the underlying racist and xenophobic climate created in Italy.  The European Committee of Social Rights found that Romani camps have been destroyed and their inhabitants forcibly evicted and often expelled from Italy by state police or other representatives of the public authority, often

The applicants were permanent residents in South Africa. They challenged legislative provisions, which limited entitlement to social grants for the aged to South African citizens, and would prevent children of non-South African citizens in the same position as the applicants from claiming any of the childcare grants available to South African children (regardless of the citizenship-status of the children themselves).
