صُرف ألفريدو لاغوس ديل كامبو من وظيفته في الأول من تموز/يوليو عام 1989. كان السيد لاغوس ديل كامبو قياديًا نقابيًا ، بيد أنه في وقت إقالته كان يرأس الهيئة الانتخابية، ممثلًا مُنتخبًا للجماعة الصناعية في الشركة (نوع من منظمات العاملين المنُشأة بموجب القانون). أجرت إحدى المجلات مقابلة مع السيد لاغوس بصفته رئيسًا للجنة الانتخابية، صرّح فيها عن شجبه العلني للاجراءات التي اتخذها رب العمل الذي كان برأيه يمارس ضغوطًا على العاملين مستخدمًا الابتزاز والأساليب القسرية. ولم يمض وقت طويل على هذه المقابلة حتى طُرد السيد لاغوس دل كامبو من وظيفته ردًا على تصريحاته.

Corte Interamericana reconoce la justiciabilidad directa de los DESC

Alfredo Lagos del Campo fue despedido de su trabajo el 1 de julio de 1989. Previamente había sido sindicalista, pero en el momento del despido era el presidente del Comité Electoral, un representante electo de la Comunidad Industrial de la empresa (un tipo de organización de trabajadores previsto por la ley en Perú).

Inter-American Court recognizes the direct enforceability of ESCR

Alfredo Lagos del Campo was fired from his job on July 1, 1989. Mr. Lagos del Campo had previously been a union leader but, at the time of his dismissal, he was the President of the Electoral Committee, an elected representative of the company’s Industrial Community (a type of employee organization in Peru created through law). Mr. Lagos del Campo gave an interview for a magazine in his capacity as President of the Electoral Committee, stating he had publicly denounced actions by his employer who he believed was pressuring workers using extortion and coercive tactics.

El 2002, el Comité de Derechos Humanos de la ONU (CDH o Comité) aceptó la comunicación como admisible para su consideración. El caso se refiere a la situación de K.L., una mujer de 17 años de edad que estaba embarazada y cuyo feto padecía de anencefalia. La anencefalia es una enfermedad incompatible con la vida del feto y que amenaza la salud de la embarazada. Su médico le informó a K.L. que las complicaciones del embarazo la exponían al riesgo de muerte. Siguiendo este consejo, ella decidió poner fin al embarazo.

In 2002, the UN Human Rights Committee (HRC) accepted this communication as admissible for consideration. This case concerns the plight of K.L., a 17-year-old who was pregnant with an anencephalic foetus. Anencephalia is a condition incompatible with life for the fetus, and that jeopardizes the pregnant woman's health. Her doctor informed K.L. that her pregnancy complications exposed her to a life-threatening risk.  Upon his advice, she decided to terminate her pregnancy.

Marco Antonio Arana Zegarra presentó un recurso constitucional contra una decisión del Tribunal Superior de Justicia de Cajamarca que rechazaba su solicitud de que el proyecto Conga de la empresa Yanacocha sea suspendido por las amenazas que significaba para el derecho a la vida en un medio adecuado y equilibrado, y sobre la base de irregularidades ocurridas durante la aprobación del EIA del proyecto.

Marco Antonio Arana Zegarra filed a constitutional remedy against a ruling by Cajamarca´s Superior Court of Justice that dismissed his complaint requesting that Yanacocha´s Conga project be suspended due to the threats it posed to the right to live in an adequate and balanced environment, and on the basis of irregularities in the approval of the project’s EIA.

A group of retired citizens filed a petition with the Inter-American Commission on Human Rights (IACHR) against the State of Peru. The IACHR subsequently filed an action with the Inter-American Court of Human Rights alleging violation of rights to private property and judicial protection, and of the obligation to ensure progressive realization of social rights. During their active working life, the petitioners were employed as officials of a State agency that had its own pension fund.

An HIV/AIDS-positive person submitted an amparo action with Peru's Health Ministry requesting full medical care, including permanent supply of drugs and periodical testing, as well as CD4 and viral load tests. The petitioner alleged to lack enough financial resources to face the high cost of the treatment. The Court accepted the amparo action and ordered government agencies to comply with Article 8 of Law 26626, which set forth that a Plan to Fight AIDS should have top priority in the budget.
