The debate about having a debate about a business and human rights treaty

This article summarizes some of the current debate and argues in support of the treaty process for the following reasons: (i) states are pushing for change so those against it are self-interested and may fear shift in state hierarchy, (ii) states pushing for it have suffered the worst, (iii) legal remedies are becoming fewer due to recent US decisions on the ATS and states refusing extraterritoriality, (iv) some states lack capacity to deal with violations, (v) international trade and investment law can hinder state's abilities to deal with violations, and (vi) multilateral treaties are used in other areas like terrorism and anti-corruption.
