محكمة بريطانية تعزز تمتع المرأة بحقها في السكن الملائم وحقها في الحماية الاجتماعية

أعد مجلس إقليم ساندويل الحضري خطة ضريبية جديدة بموجب تغيير وطني في قانون الضرائب. في السابق كان ذوو الدخل المنخفض يُمنحون مساعدة مالية لدفع الضرائب البلدية المستحقة، لكن بموجب الخطة الجديدة خُفّضت الالتزامات الضريبية المستحقة على الأفراد على أساس الوضع المالي. ينص النظام الأساسي ذو الصلة على أنه يجوز للسلطات المحلية وضع خطط مفصلة حسب الأوضاع المحلية لتحديد الالتزامات الضريبية المستحقة عن طريق تصنيف الطبقات على أساس الدخل ورأس المال وعدد المُعالين. كان من المقرر نشر مسودة الخطة وكان يتوجب على السلطة  المحلية التشاور مع الأطراف المعنية.

UK Court advances women’s enjoyment of the rights to adequate housing and social protection

The Sandwell Metropolitan Council formed a new tax plan pursuant to a national change in tax law. Previously, low-income persons would be given financial assistance to pay council taxes, whereas under the new plan, individuals’ tax liability was lowered based on financial status. The relevant statute stated that local authorities would create locally-tailored plans to determine tax liability by creating classes based on income, capital, and number of dependents.

A Rusi Kosev Stanev le diagnosticaron esquizofrenia en 1975 y fue declarado incapaz de trabajar en 1990. En el año 2000, tras un pedido de su madrastra y su hermanastra, un tribunal lo declaró parcialmente discapacitado legalmente sin notificarle. Dado que sus familiares no aceptaron hacerse cargo de la tutela, un funcionario municipal fue designado tutor. Sin informar a Stanev, el tutor solicitó que se lo ubique en un hogar de asistencia social para 'personas con enfermedades mentales'.

Rusi Kosev Stanev was diagnosed with schizophrenia in 1975 and declared unfit to work in 1990. In 2000, following a request from his stepmother and half-sister, a court declared him partially legally incapacitated without notifying him. Since his relatives declined guardianship, a municipal council officer was appointed his guardian. Without informing Stanev, the guardian requested that he be placed in a social care home for 'people with mental disorders'.

El 2002, el Comité de Derechos Humanos de la ONU (CDH o Comité) aceptó la comunicación como admisible para su consideración. El caso se refiere a la situación de K.L., una mujer de 17 años de edad que estaba embarazada y cuyo feto padecía de anencefalia. La anencefalia es una enfermedad incompatible con la vida del feto y que amenaza la salud de la embarazada. Su médico le informó a K.L. que las complicaciones del embarazo la exponían al riesgo de muerte. Siguiendo este consejo, ella decidió poner fin al embarazo.

In 2002, the UN Human Rights Committee (HRC) accepted this communication as admissible for consideration. This case concerns the plight of K.L., a 17-year-old who was pregnant with an anencephalic foetus. Anencephalia is a condition incompatible with life for the fetus, and that jeopardizes the pregnant woman's health. Her doctor informed K.L. that her pregnancy complications exposed her to a life-threatening risk.  Upon his advice, she decided to terminate her pregnancy.

في عام 2012، وافقت اللجنة الأفريقية لحقوق الإنسان والشعوب على النظر في هذه الشكوى ورأت أنها جديرة بالقبول. وقد رفع هذه الدعوى ثلاثة مدافعين بارزين عن حقوق الإنسان هم: منعم الجاك، وأمير سليمان، والراحل عثمان حميدة،  إثر استهدافهم بسبب تعاونهم المزعوم مع المحكمة الجنائية الدولية في التحقيقات التي تجريها حول العديد من الزعماء السياسيين السودانيين. وكان جهاز الأمن والمخابرات الوطني السوداني قد اعتقل المدافعين الثلاثة لمدة ثلاثة أيام، تعرضوا في خلالها للتعذيب ولسوء المعاملة.

En 2012, la Comisión Africana de Derechos Humanos y de los Pueblos (la Comisión) aceptó esta comunicación considerándola admisible para su evaluación. El caso fue presentado en nombre de tres defensores de los derechos humanos prominentes que trabajaban en Sudán: Monim Elgak, Amir Suliman y el fallecido Osman Hummaida, quienes eran perseguidos por su supuesta cooperación con la Corte Penal Internacional en su investigación de varios líderes políticos del Sudán.

In 2012, the African Commission on Human and People’s Rights (Commission) accepted this communication as admissible for consideration. The case was filed on behalf of three prominent human rights defenders working in Sudan, Monim Elgak, Amir Suliman and the late Osman Hummaida, who were targeted for their alleged cooperation with the ICC in its investigation of several Sudanese political leaders. The three men were arrested by Sudan’s National and Intelligence Services (NISS), tortured and maltreated for three days.

En este caso se unieron dos demandas colectivas presentadas bajo la Ley de Reforma de Litigios Penitenciarios de 1995 (PLRA), la cual permite que los reclusos inicien acciones judiciales por violaciones de derechos constitucionales. Las cárceles de California fueron diseñadas para albergar a unos 80.000 presos, pero a la fecha de la presentación el sistema tenía aproximadamente 156.000 reclusos.
